Crew of Palma de Mallorca suffers a grotesque disciplinary dismissal process on Ryanair
The Cabin Crew are dismissed for having declared themselves incapable of flying above the maximum hours allowed by law.
The crew had to carry out Palma-Madrid, Madrid-Palma, Palma-Colonia and Colonia-Palma.
On July 8, the crew had to deal with numerous delays and incidents (lack of ground staff, late pick-up of passengers with wheelchairs, complaints from passengers, etc.). Already on the third flight, from Palma to Cologne / Bonn, the cabin crew communicated to the captain that they were at the limit of their psychophysical faculties, as foreseen by the European legislation (FTL), mandatory and of imperative inclusion in the operations manual of each EU company. In Cologne, the captain evaluated the situation of the cabin crew to fly above the legal limit, in that case, 12 hours that could reach 15. He decided not to apply his prerogative of exceptional extension of the flight duty period and instead accepted that his crew was unable to continue. The chief operations pilot in Dublin gave the go-ahead for the cabin crew option.
In addition to all this, it was evident that neither the plane nor the crew had potable water. The crew must take from their homes the water that they drink!
Then appeared the management offensive: Intimidatory calls from the heads of the client areas tried to make a dent in the cabin crew. One by one, they sought to twist the arm of the crew who exerted their right not to question the safety of the operation with passengers on board. It was in vain. We must remember that the law is not negotiable and the cabin crew itself, to voluntarily exceed the legal mandate, would have to go through an air safety inspection process if they unreasonably exceeded that legal maximum of 12:00 for those four flights. It is the principle of responsibility contained in the ad hoc laws.
After a long wait they were ordered to go to rest at a hotel in Cologne and fly from there to Manchester; Next, fly to Dublin to face a disciplinary process. At the hotel, after 02:30, after 15 hours of uniform, very stressed and without a suitcase, they tried to rest. At 05:30, they had to leave the hotel, to take their flight to Dublin. They were barely able to get three hours of sleep.
In that physical and mental state (tired, stressed and lacking a proper shower) they had to undergo an unprecedented harassment, completely unrelated to "Flight Safety" as mandated by law and focused exclusively on retaliation, based on a false accusation of disobedience. After holding them for hours and not being available any flight to Palma, they were sent to a bed and Breakfast where they had to share a room and a single bathroom, being the cabin crew of both sexes. The taxi and the maintenance they had to pay for it themselves.
They had to assist to the disciplinary meeting without any legal or union advice present; None of this is allowed on Ryanair in 2018.
In Cologne, everything was against the decision of the crew staying: It's not your house, you do not have luggage, there's hostility from Ryanair's management, you do not know at what time, where and how you're going to sleep and you're busted. The law protects you and your boss wants you to skip it ...
Today, Friday, July 13th, there have been disciplinary meetings and not those of safety investigation in flight, as required by law. In those meetings the four cabin crew members have been fired. The disciplinary panel oferred one of them to be saved if he blamed the others. This is the example of a non-blushing behavior. The cabin crew live in Mallorca and perform a very hard work in a company that skips all the legislation under the contemplative look of the EU and all member countries, with the exception of France, Norway and Denmark, countries where Ryanair does not have bases, because it doesn’t want to comply with the national legal requirements.
Is that the security that Ryanair offers to its 600 aircraft flying across the EU? Good to know, once and for all ...
