Authorities in key hubs are taking notice. The UK Civil Aviation Authority has accused the carrier of misleading cancelled passengers about their rights, and Italy has launched an inquiry into alleged violations of consumer rights. If Ryanair is forced to do more on consumer care, that could drive costs.

The regulator asked for a meeting with the airline as part of a consultation that will last at least seven days and could take legal action for breaching consumer protection laws.
It says Ryanair has falsely claimed it did not have to re-route passengers on other airlines, particularly when there are no other services available.
The CAA also accused the airline of stopping short of providing details on its obligations to refund additional expenses incurred by passengers as a result of cancellations including for meals, hotels and transfer costs.
It enforces consumer rights for passengers on UK flights under the Enterprise Act, meaning it could take Ryanair to court, where it would face being fined.

A settembre il traffico passeggeri di Ryanair e' aumentato del 10% raggiungendo gli 11,8 milioni di clienti. Il coefficiente di riempimento, comunica la compagnia, e' cresciuto del 2% raggiungendo il 97% e il traffico annuo e' aumentato del 12% raggiungendo a settembre i 127,3 milioni di clienti.
"I dati presentati tengono conto dei 2.100 voli cancellati tra settembre e ottobre - ha affermato Kenny Jacobs, Chief Marketing Officer di Ryanair - Ad oggi, il 98% dei clienti coinvolti in queste cancellazioni e' stato rimborsato o riprottetto. Ryanair pilots face HMRC investigation over airline's employment structures


Ryanair pilots are being investigated by HM Revenue & Customs over complex employment structures imposed on them by the no-frills airline.

Several experienced pilots told the Guardian that they have faced tax investigations relating to the way in which they are employed by Ryanair. Europe’s busiest airline is already grappling with a PR disaster caused by errors in how pilots are rostered for work – leading to the cancellation of tens of thousands of flights through to March next year, which has disrupted the travel plans of 700,000 passengers.

Ryanair has also clashed with its pilots over their working conditions, with many complaining about the same contract arrangements that have piqued HMRC’s interest.

The tax authority’s focus on individual pilots emerged two years after it launched an investigation into Ryanair’s use of agencies such as Brookfield Aviation to provide about half of its 4,200 pilots.

Those who apply to join Ryanair are told to set up an Irish limited company and are made directors of it, under the guidance of accountants recommended by the airline. That company then supplies pilots to one of several agencies, including Brookfield Aviation and McGinley Aviation, who in turn supply them to Ryanair.

The system limits Ryanair’s obligations to the pilots, such as sick pay – among the factors that allows the Dublin-based carrier to keep its costs low. But the use of Irish limited companies to employ pilots based in the UK has led to pilots with limited experience of the tax obligations of a limited company falling foul of its fraud investigators.

One UK-based pilot said he has been under investigation since February 2015, and is being questioned by HMRC about an employment structure he had no choice but to use.

“When I started employment, I had to set up a limited company in Ireland with two other pilots who I knew from training and were employed by Ryanair at the same time. We had to go to Ireland, meet their accountant and set up a company.”

He said his lack of experience of acting as a company director meant he left tax affairs to the accountant recommended by Ryanair, but has still been hit with a two-year investigation.

“You’re sitting there waiting for the brown envelope to hit the doormat,” he said.

“I’m no tax expert and I thought I was doing everything correctly. Now I’ve had to send my logbook off, which is priceless to me.”

A former colleague, who used to train pilots for Ryanair, said: “The public should be aware that some of the pilots flying the planes are stressed because of the way they operate.

“You have HMRC hounding people who have been pulled into this system that is run by Ryanair.”

A third pilot, who is under investigation for non-payment of taxes over five years, said HMRC told him tax on his earnings should have been paid in the UK, even though he was employed by an Irish limited company.

He said he had been given “no control over the governance of the way [tax] was being paid”.

According to one letter sent to him by HMRC and seen by the Guardian, the tax authority conceded that he had not “engineered” the complex structure and was simply trying to gain employment.

“You speak to some of the people affected by this and they’re broken men,” he added.

Another pilot showed the Guardian a document in which the agency he worked for told him sign a disclaimer to say he was not an employee of the company but of his own Irish limited company.

He said this structure ultimately led HMRC to look into his tax affairs, causing him undue anxiety.

“It was one of my main reasons for leaving. I was sick of always being worried if I was paying tax correctly,” he said.

And he warned that pilots from other countries are also facing investigations by their domestic authorities.

“I flew with one guy who had to sell his house and car because he’d been landed with a tax bill of €40,000,” he said. “He hadn’t been fiddling it on purpose but he’d just got it wrong.”

A fifth pilot said British pilots were now worried about their homes being raided, pointing to action taken by Germany tax authorities last year over pilots employed by Brookfield Aviation.

“Imagine doing this job when you are constantly worrying about whether what you are doing tax-wise is legal, simply because you are not given any other option by your own employer,” he said.

All of the pilots interviewed also warned that the use of self-employed contracts, which do not entitle them to sick pay, meant some were turning up to work even if they were ill.

HMRC said: “We don’t comment on identifiable individuals or organisations.”

Ryanair said: “We do not comment on rumour or speculation.”

Ryanair today (2 Oct) updated its progress on the cancellation of 20,000 of its 800,000 flights between September and March as follows:

For cancellations announced on 18 Sep:

– All 315,000 customers received email notices
– Over 308,000 alternative routings or refunds (over 98% of affected customers) have now been processed
– The remaining 2% of customers (less than 7,000) have yet to contact Ryanair

For winter schedule changes announced on 27 Sep:

– All 400,000 customers have received email notices
– Over 300,000 alternative routings or refunds (over 75% of affected customers) have now been processed, which we expect will rise to over 90% of customers (over 360,000) this week.

– Over the last 7 days, Ryanair’s first wave punctuality has improved to 97% (see table below)
– Over the last 7 days, only 2 out of 16,000 flights operated were cancelled (see table below)

Guarda, non fa una piega.
Tanto criticata ma si sta dimostrando molto all altezza nel recuperare, considerando gli eventi.

Ryanair Responds Fully To CAR (& CAA) Requirements To Clarify Customer Entitlements During Cancellations

Ryanair today (29th Sept) met with the Irish Commission for Aviation Regulation (CAR) and agreed to implement a series of steps to address the CAR’s requirements to ensure that all customers affected by Ryanair’s recent rostering related flight cancellations are fully aware of their EU261 rights and entitlements, including full refunds, or re-accommodation onto other Ryanair flights or other comparable transport options with reimbursement of reasonable out of pocket expenses.

The steps agreed with the CAR are as follows:

1 Ryanair has today issued a clarification email to all affected customers outlining their rights to refunds, re-routing on Ryanair or on other comparable transport options and expenses (see below).

2 Ryanair has also today issued a press release explaining to customers how and when they will be re-accommodated on other Ryanair flights or other airline flights. This press release will be displayed on the home page of Ryanair’s website from today.

3 Ryanair has updated the FAQ pages of its website to reflect all of these changes.

Ryanair has also today replied to the UK CAA letter of 28 Sept, agreeing to meet its requirement for customer clarification on Ryanair’s EU261 obligations, which are in line with those requested by the CAR.
Ryanair has called upon the UK CAA to now require UK airlines to comply with these EU261 obligations which the CAA did not apply to British Airways in May this year, when a computer meltdown stranded hundreds of thousands of British citizens/visitors at London Heathrow and many other airports, with no apparent action taken by the CAA in respect of re-accommodation or enforcement against British Airways.

Ryanair Explains How And When It Will Re-Route Customers Affected By Flight Cancellations

Ryanair today (29th Sept) emailed all (under 1%) of its customers who were affected by its deeply regretted 2,100 flight cancellations in Sept/Oct, or the 18,000 schedule changes (announced on Wed, 27th) from November 2017 to March 2018, in order to explain their entitlements under EU261 regulations as follows.
Ryanair is required to offer disrupted customers (on cancelled flights) the option of a full refund or re-routing to their final destination as follows;

(A) Refund Option:

A full refund will be given of an unused flight sector and associated fees. If the disrupted flight is their outbound sector, customers will also be offered a full refund of the return sector.

(B) Re-routing Options:

Ryanair will offer all disrupted customers the following sequence of re-accommodation options;

1 First, move the customer to the next available Ryanair flight on the same route.

If this option is not available same or next day, then;

2 Move the customer to the next available Ryanair flight from/to a suitable alternative airport/s (for example: Luton or Gatwick in the case of Stansted).

If this option is not available same or next day, then;

3 Offer the customer re-accommodation on any one of our agreed disruption partner airlines to their destination as follows;

Easyjet, Jet2, Vueling, Cityjet, Aer Lingus, Norwegian or Eurowings airlines.
If this option is not available same or next day, then;

4 Offer the customer re-accommodation on any comparable alternative transport (another airline flight, train, bus or car hire) with the cost of this comparable transport ticket to be assessed on a case by case basis.

Under EU261, Ryanair will also reimburse any reasonable out of pocket expenses incurred by customers as a result of these flight cancellations, subject to receiving an EU261 expense claim form from customers supported by original receipts.
If any Ryanair customer on one of these disrupted flights believes that they may have chosen an option that was not suitable for them as a result of any misunderstanding of their EU261 rights, then they should write directly to Ryanair’s Director of Customer Services and Ryanair will assist them in any way it can to obtain their full EU261 rights and entitlements.

Ryanair’s Kenny Jacobs said:

We apologise again sincerely for the disruption and inconvenience our rostering failure has caused some of our customers. Over the past week we have refunded/reaccommodated over 97% of the customers affected by the 18th September cancellations. This week (by close of business on Sun, 1st Oct), we will have reaccommodated/refunded over 90% of the 400,000 customers who were notified of schedule changes (on flights between November 2017 and March 2018) on Wed 27th.
In addition, every single affected customer has received a travel voucher for a €40 one way flight (€80 return) for travel in October to March. We have restored the reliability and punctuality of our flight operations. Over the past 7 days we have operated over 15,000 flights with over 96% of our first wave morning departures operating on time, or with zero flight cancellations.
We have taken on extra customer service staff and are moving now to process and expedite all EU261 claims from affected customers. We are committed to processing all such claims within 21 days of receipt and hope to have all such claims settled before the end of October.”

Ryanair expected to 'fully comply' with EU obligations

The European Commission has contacted Ryanair regarding the recent cancellation of flights and says it expects the airline to fully comply with EU obligations.

Europe's Transport Commissioner told the European Parliament that the company needs to give passengers correct information regarding their rights, particularly in relation to re-routing and compensation.

The airline was forced into the cancellations after miscalculating pilot leave, possibly affecting over 400,000 passengers.

Transport Commissioner Violeta Bulc said all of Ryanair's communication channels "need to work properly", allowing passengers to communicate with staff.

She also said full information on the complaint handling process must be available on the Ryanair website.

Ms Bulc acknowledged that Ryanair responded and assured the commission that it would address the issues raised.

She said she would pursue contacts with Ryanair and the Irish Aviation Authority during a visit to Dublin in the coming days.
We expect all airlines operating in EU to fully respect EU rules," she said.

Ms Bulc said it is the responsibility of the Irish Authorities to oversee Ryanair.

Responding to a debate in the European Parliament on the recent cancellation of flights, she said she was confident that if Irish authorities saw wrongdoing, they would respond accordingly.

She pointed out that there are sanctions for infringements of the regulation laid down by member states under national enforcement bodies.

She said she did not believe there was an infringement on behalf of Irish authorities and that she was confident they would do the work they have to do.

Ismail Ertug who is a Social and Democrats German MEP said there were questions for the Irish Aviation Authority who he said were responsible.

Sinn Féin MEP Matt Carthy said there should be no surprise about Ryanair's "disrespectful treatment" of passengers because he said they treat their workers disrespectfully.

Meanwhile, Fine Gael MEP Deirdre Clune, who is a member of the Parliament's Transport Committee, said it should be made clear that the problem resulted from a rostering management failure and not a safety matter, despite varying reports.

ANALYSIS: Ryanair still among biggest despite capping growth

Ryanair's disclosure that passenger numbers jumped 10% in September, even amid flight cancellations, underlines the extent to which the budget carrier is still growing despite the pilot-rostering challenges that have clipped its planned expansion.

The airline has today detailed passengers numbers that, on an earned-seat basis, were up 10% at 11.8 million in September – a month which includes more than 2,000 flight cancellations. While below the 12% rise recorded for the rolling year to date – and only incorporating two weeks of cancellations – this still illustrates a strong growth rate.
Ryanair had initially hoped to confine flight cancellations to six weeks in September and October after the scale of an over-allocation of pilot leave became clear. But the airline subsequently opted to ground 25 aircraft over five months during the winter and will operate 10 aircraft fewer than planned next summer, in a bid to draw a line under the pilot-rostering issue once and for all. The carrier will suspend 34 routes between November and March 2018.
The impact will be a slowing in its capacity growth over the winter months, from 9% to 4%, and the airline now expects to carry two million fewer passengers in flying 129 million over the year ending 31 March 2018 – and four million fewer in flying 138 million the following year.
But that still represents not only the highest figure of passengers carried by a European airline, but also strong growth for the year overall. Ryanair remains in the rapid expansion mode it has been in since ending its fleet-growth hiatus with a major follow-on Boeing 737-800 order in 2013.

FlightGlobal schedules data shows that as of 28 September, Ryanair was set to lift capacity around 11% in terms of flights over the five months from November to March compared with the same five-month period in 2016-17. That includes a little over 27,000 additional flights. Ryanair says it is cancelling around 18,000 flights, meaning it will still operate around 9,000 more flights this winter than in the same period last year.
That would still involve the carrier growing faster, in absolute terms, than most in Europe. And even after the cuts, it will still by a distance operate more flights than any other European carrier this winter.
SERVICE INTERRUPTION
Details of the routes impacted show that much of the Irish carrier's UK domestic network will be suspended over the winter season as part of efforts to tackle its pilot-rostering issues.
The airline, which only resumed UK domestic operations three years ago, will suspend its London Stansted routes from Edinburgh and Glasgow, as well as its Belfast link to London Gatwick. That leaves flights from Derry to Liverpool and Glasgow as Ryanair's only UK domestic routes over the winter period.

The UK is one of the most impacted countries in terms of its representation among the 34 routes Ryanair is suspending between November and March. Eleven routes covering six UK airports are on the list.
But the biggest country casualty among routes being suspended is Italy. Fourteen services, including seven from Trapani, are being put on hold during the winter.
Greece, Poland and Germany are also among the most impacted countries, while the Bulgarian capital Sofia, German city Hamburg and Thessaloniki in Greece each have five services being suspended.

PROFIT FORECAST UNCHANGED

Ryanair put the cost of the initial cancellations at up to €25 million – a combination of the lost profitability and the passenger compensation.
It also expects slightly lower yields over the next two months as it undertakes various seat sales. But Ryanair has not changed it full-year guidance of a net profit of €1.4-1.45 billion.
Likewise, it adds: "Over the next two years as Ryanair hires more pilots and raises pilot pay, costs will rise slightly but we don't believe this will impact profitability."
Until recently, the carrier had a practice of voluntarily grounding some aircraft over the winter rather than operating them on routes that were loss-making during those months. New airport deals and a greater emphasis on routes with a business appeal to mitigate seasonality have altered that picture. But cancelling routes during the lower-yielding winter months limits the lost revenue. The extra notice also means cancellations are not eligible for EU passenger compensation.
While Ryanair's profit expectations are undented, this should be set in the context of relatively strong European carrier financial performance. Ryanair left its outlook unchanged despite a strong first quarter, but several European carriers – admittedly, most operating to a calendar year and thus at the halfway stage of their financial years – lifted their profit outlooks, including Austrian Airlines, Finnair, Icelandair, Lufthansa and SAS.
A profit within Ryanair's guidance would still mark an improvement on the €1.32 billion net profit it recorded for the year ended March 2017. That was the third-highest profit, net, among European airline groups for the last financial year.

There has been impact on the carrier's share price. This has fallen from a year-high of just over €19 in the middle of September to its current price hovering below the €17 level. That, though, is in the context of continued strong growth over most of the year. The share price has been climbing from €12 a year ago.
Ryanair chief Michael O'Leary has also spoken of reputational damage for the carrier. After the biggest publicity hit since Ryanair's adoption of its more customer-friendly "Always getting better" campaign, O'Leary responded in direct but contrite fashion. "This is a mess of our own making," he said following the first round of cancellations. "I apologise sincerely to all our customers for any worry or concern this has caused them."
The flight cancellations also represent the first big setback for Ryanair's overhauled management team. The carrier appears to have identified a need for a tighter grip on operations: its chief people officer Michael Hickey has taken over the pilot recruitment and rostering function, and the airline has abandoned any interest in bidding for Alitalia, in order to "eliminate all management distractions".

Ryanair’s Kenny Jacobs said:
“These figures include the 2,100 flight cancellations announced for September and October. We have now refunded/re-accommodated 98% of customers who were impacted in September and October. The remaining 2% of affected customers have yet to contact us. We again sincerely apologise to our customers for these deeply regretted cancellations.”


Tagliando voli aumenti per forza i load factor. E la crescita del 10% andrebbe rapportata all'aumento dell'offerta. La flotta è cresciuta parecchio nel 2017.

A Settembre sono stati cancellati il 2% scarso dei voli nella seconda metà del mese, quindi circa l'1% su base mensile. Le variazioni rispetto ad una situazione ordinaria non potevano che essere minime.
Come impressione generale, credo che FR sia riuscita a riproteggere la maggior parte dei pax sui propri voli. Per cui la crescita percentuale dei pax è rimasta la stessa di Agosto e solo leggermente inferiore a Luglio (+11%), Giugno (+12%) e Maggio (+11%).
Il LF invece è cresciuto di 2 punti (come a Giugno), mentre Agosto, Luglio e Maggio l'aumento era stato di un solo punto.
Tutto considerato se la maggioranza dei pax di voli cancellati ha comunque volato FR (con basse spese di riprotezione per la compagnia) e al contempo MOL si è trovato in cassa i soldi risparmiati annullando i voli, il danno potrebbe anche essere più limitato del previsto.

Il Telegraph qui in UK dice che gli aa/vv stanno tramando uno sciopero imponente e una defezione di massa in easyJet.
Vediamo quanto ci sara' di vero.

Ryanair cabin crew 'plotting mass strike and desertion to easyJet'

Ryanair cabin crew are planning to walk out on the airline over working conditions before absconding to a rival, one of the embattled carrier’s flight attendants has claimed.​
Contacting Telegraph Travel under condition of anonymity, the member of staff, who has been working for the airline for three years, said: “It is written in our contracts that we are not allowed to be in unions, but colleagues from my base and not only [mine], are planning a strike before moving to Norwegian and easyJet.
“Imagine that the five aircraft of our base will not depart on one day. And we are talking only about five aircraft in my base. It will be a mess.”

Working conditions at the airline have come under scrutiny recently after the carrier was forced to cancel thousands of flights following a “mess up” with its pilots’ holiday roster.

Last week another Ryanair flight attendant made allegations about a number of startling working practises at the airline, including only being paid for “flying time”, charging staff full price for water and sandwiches, and encouraging members to compete against each other for in-flight sales. The airline did not respond to specific details of the article but said that its cabin crew earn up to €40,000 (£35,500) a year and “enjoy great terms and conditions including job security... a legal max of 900 flight hours per annum... [and] great sales commissions”.
Also this week, it emerged that a letter had been circulated among Ryanair pilots encouraging support for an “unofficial” union “to oppose the long-standing strategy of divide and conquer that Ryanair has applied in its dealing with pilots”.

“To overthrow this structure will require immense force of will, stamina and commitment from every pilot,” the letter read.
“It is entirely possible that things will get worse before they get any better. Expect management to fight any change by all means available to them. There will be casualties.
“To paraphrase Churchill: Let us make sure future colleagues look back and say: ‘This was their finest hour’.”
The flight attendant who contacted Telegraph Travel accused Ryanair of being the “North Korea of aviation”.

“The situation is getting worse,” they said. “We work more than 100 hours a month. I said work? No, we are paid for 100 hours a month but we work something like 140-160 since they don't consider the ‘turnarounds’ duty time. We can have six turnarounds a day. Is this safe? I don't think so.”
They added that staff must pay £30 a month rental of their uniforms.

“I have a lot of ex-Ryanair friends working for Norwegian, easyJet and Wizzair. You cannot even compare the conditions,” the flight attendant said.
According to both flight attendants to speak out, Ryanair staff are discussing their options on closed groups on social media.
Asked to comment on the prospect of a walkout, a spokesperson for the airline said: “We don’t comment on rumour or speculation.”

Asked to comment on cabin crew having to rent their uniform and not being paid for turnaround time, the spokesperson said: “Untrue.”
Europe’s largest carrier has had a torrid time since announcing that mishandling of its pilots’ holidays meant it was having to cancel a large swathe of flights up until the end of October. Ryanair then announced the cancellation of 400,000 more bookings as it attempted to “slow growth” and shore up its long-term punctuality.

Responding to the original article on working conditions, Ryanair said: “Ryanair cabin crew earn up to €40,000 p.a. and enjoy great terms and conditions including job security, a recently negotiated five year pay deal with guaranteed pay increases, a five-on, three-off roster (a bank holiday weekend every week), a legal max of 900 flight hours p.a. (just 18 hours per week), great sales commissions which further boosts pay, free training, sick pay and an annual uniform payment of up to €425. This is why we currently have a waiting list of over 3,000 young people who all hope to join Ryanair’s cabin crew team, at a time when other airlines and their unions are negotiating job cuts, pension cuts and pay cuts. We don’t comment on rumour or speculation especially when it originates from competitor airline unions.”
