Lufthansa's 2012 transfer of thousands of staff from its Austrian Airlines unit to the cheaper Tyrolean Airways division was not legal, a Vienna court ruled on Monday.

Austrian Airlines said in a statement it would appeal against the verdict of the Vienna Labour and Social Affairs Court, which called into question the centrepiece of the loss-making airline's restructuring.

Lufthansa has said the partial transfer of Austrian Airlines' flight operations to Tyrolean, involving around 2,000 staff, boosted its 2012 operating profit by EUR€115 million (USD$152 million), helping it return to profit.

A spokesman for the Vienna court said the court's ruling meant the staff were still employees of Austrian Airlines, with their more generous employment contracts, pending possible appeals to two higher courts.

Austrian Airlines chief executive Jaan Albrecht said in the statement: "We will pursue every legal avenue at its disposal in the appeals process in order to also legally safeguard our restructuring path."

"In the meantime, we hope that the talks initiated with the works council on the collective wage agreement will result in a viable solution independent of the decision handed down by the court," he added.

About 300 staff left Austrian Airlines over the bitterly fought transfer last year, many of them receiving large payouts.

Lufthansa: disdetta accordi personale bordo su pensioni e ricollocamento

(Il Sole 24 Ore Radiocor) - Milano, 02 set - Lufthansa, prima compagnia aerea tedesca, ha annunciato di voler disdettare gli accordi tariffari con i sindacati sulle pensioni e il ricollocamento del personale di bordo perche' troppo costosi. Secondo quanto annunciato da Peter Gerber, consigliere responsabile del personale, la disdetta sara' comunicata ufficialmente nei prossimi giorni con scadenza a fine anno anche se, in attesa di un nuovo accordo, gli accordi continueranno ad avere validita' per i vecchi dipendenti. I nuovi dipendenti, invece, saranno sottoposti ai nuovi accordi. Ai 60mila dipendenti tedeschi, quindi, non sara' piu' garantito il rendimento, previsto dall'accordo tariffario, del 6-7% sui fondi destinati alla pensione. La garanzia sui tassi e la crescente aspettativa di vita, ha detto Gerber, hanno aumentato costantemente gli oneri per Lufthansa negli ultimi anni. Lufthansa, che da tempo soffre per la crescente concorrenza delle compagnie low-cost e di quelle degli Stati del Golfo, conta da sempre su un piano pensioni molto ramificato che risale ancora agli anni anteriori alla privatizzazione e che garantiscono, con un contributo dell'azienda, il rendimento concordato nei patti anche se i tassi di mercato sono molto inferiori. D'ora in avanti, cosi' Gerber, il rischio di mercato dovra' essere sopportato dai dipendenti. I sindacati del personale di bordo hanno gia' di non accettare la decisione della compagnia e di voler procedere eventualmente insieme al sindacato dei piloti Cockpit e a quello dei servizi,

Austrian Airlines-Tyrolean new wage agreement could lead to merger

Austrian Airlines and its Tyrolean Airways subsidiary presented its employees with a framework plan for a new collective wage agreement, which could lead to the merging the two carriers and eliminating the Tyrolean brand.

The agreement includes new flight duty rules, a new salary scale, a profit-sharing scheme based on net profit, a revised pension fund model as well as a new career model for cabin and cockpit staff. It also includes a revised pension fund model and a new career model.

Following failed negotiations in 2012, the entire flight operations of Lufthansa subsidiary Austrian Airlines were transferred to Tyrolean Airways, encompassing about 1,900 employees and all the aircraft.

Austrian said the new agreement is a means to increase planning certainty and creating the basis for future decisions. Negotiations should be concluded by May 31.

“Our employees wish for an agreement and a clear perspective moving forward. They also desire to return to Austrian Airlines. We want to make this possible,” Austrian Airlines CEO Jaan Albrecht said. After tough restructuring measures over the past few years, “Austrian is once again operating profitably and wants to take the next steps into the future. We have Lufthansa’s support in this,” he said.

Tyrolean Airways MD Klaus Froese said, “The most difficult task was developing a new career model. Other airlines have failed precisely for this reason,” he said, adding, “The centerpiece of our model is a transparent and fair allocation formula for pilots of the regional fleet and pilots of larger types of aircraft to be appointed to vacant plane captain jobs.”

“This year, Austrian Airlines will make a forward-looking decision and move ahead with ordering a successor model to its fleet of Fokker aircraft. However, such a significant investment decision cannot be made without a consensus being reached on a collective wage agreement,” Albrecht said.

Austrian is considering several options for its regional fleet replacement. It operates one of the largest Fokker 70/100 fleets in Europe.

Austrian Airlines (OS, Vienna) could be repositioned as a budget carrier under the name "Austrian Wings" as one of the various options CEO Jaan Albrecht is considering in order to make EUR200million (USD259.5million) in critical cost cuts.

Austrian newspaper, Die Presse, reports Austrian's existing fleet of six B767-300s would fit into Lufthansa's plans to develop a long haul budget carrier based on the Lufthansa (LH, Frankfurt Int'l) and Turkish Airlines (TK, Istanbul Atatürk) joint-venture carrier, Sun Express (XQ, Antalya). Sun Express CEO, Paul Schwaiger, also sits on Austrian's board of directors.

Among other cost-cutting measures under consideration is the removal of Austrian's B767 fleet in addition to its ageing Fokker Aircraft (Woensdrecht) fleet of fifteen Fokker 100s and six Fokker 70s. The move would also see 300 flight crew dismissed leaving only a very lean version of Austrian. The report claims Lufthansa would only consider this option if a new collective wage agreement between Austrian management and staff cannot be agreed to.

A board room meeting is due to be held later this week to consider the airline's operational future within the confines of the Lufthansa Group given the lack of agreement between management and unions over the forced move of all pilots and flight attendants from Austrian Airlines to Tyrolean Airways (VO, Innsbruck) two years ago.

Should the European Court of Justice follow the Austrian courts in ruling the move be reversed, Austrian would once more be burdened with an increased cost structure.
